Mediation in intellectual property disputes

Mediation in intellectual property disputes

Members of our team are both practicing intellectual property representatives and experienced mediators who facilitate the voluntary resolution of disputes related to trademarks, designs, domain names, etc. through mediation. Atty. Lyubka Vassileva is listed as a mediator at the World Intellectual Property Organization (WIPO) Mediation and Arbitration Center.

Mediation is suitable and beneficial in all disputes between the owner or applicant of an intellectual property right and a third party (inter partes proceedings), including in opposition, revocation, or invalidity proceedings, infringement actions, etc., as well as in disputes concerning co-ownership of an intellectual property object or in connection with any contract relating to an intellectual property right.

If you or your client is a party to such a dispute, mediation enables you to resolve it quickly and discreetly, thus avoiding potential reputational damage and loss to the business and reducing the cost of dispute resolution. In addition, it allows for the consolidation and joint resolution in a single mediation of several disputes that would otherwise require separate actions in different jurisdictions. Furthermore, thanks to existing legal instruments such as EU Directive 2008/52 and the Singapore Mediation Convention, a settlement agreement resulting from mediation can be made enforceable not only in Bulgaria but also in other jurisdictions.
